Trivia Giveaway Official Rules
NO PURCHASE NECESSARY TO ENTER OR WIN.
These Official Rules apply to Trivia Giveaways (“Giveaways“) conducted by Fandom, Inc., 130 Sutter Street, 4th Floor, San Francisco, CA 94104 (“Sponsor“) during “Fandom 5” episodes on the Shindig platform (the “Fandom Shows”). The Fandom Shows will be held at times/locations which will be separately communicated to you. By entering any of the Giveaways, you agree to the Terms in these Official Rules.
ELIGIBILITY : GIVEAWAY ENTRANTS AND PRIZE RECIPIENTS MUST BE (A) LEGAL RESIDENTS OF ONE (1) OF THE FIFTY (50) UNITED STATES, THE DISTRICT OF COLUMBIA, PUERTO RICO OR CANADA (excluding QUEBEC) AND (B) AGED 18 YEARS OR OLDER AT THE TIME OF ENTRY TO BE ELIGIBLE. VOID WHERE PROHIBITED BY LAW. GIVEAWAY SUBJECT TO ALL APPLICABLE FEDERAL, STATE AND LOCAL LAWS AND REGULATIONS. Employees of Sponsor and its parent companies, subsidiaries, affiliates, and related entities (collectively, the “Released Entities”) and their immediate family members (Spouse, mother, father, brothers, sisters, sons, daughters or ‘step’ of each, regardless of where they reside) and/or those living in the same household of any such individual, whether or not related, are not eligible to enter or win. Sponsor is not responsible for incorrect or inaccurate entry information, whether caused by Internet users or by any of the equipment or programming associated with or utilized in a Giveaway or by any technical or human error which may occur in the processing of the eligible entries in a Giveaway. Incomplete, unreadable, inaccurate, unintelligible or late eligible entries or eligible entries which otherwise do not comply with these Official Rules will be disqualified. Sponsor reserves the right to, in its sole discretion, cancel, modify or suspend a Giveaway should any computer virus, bugs or other technical difficulty or other causes beyond the control of the Sponsor corrupt the administration, security or proper play of the Giveaway.
How to Enter: Fans who are watching the Fandom Show will be asked to become contestants and can indicate their desire to do so by “raising their hand” in the Shindig app. Contestants will be selected at random by Sponsor and Sponsor reserves the right to disqualify a contestant for any reason, including but not limited to a poor internet connection. A qualified contestant will be asked 5 questions increasing in difficulty and if he/she answers them all correctly, they win the prize described below. As soon as a contestant gets a question wrong, they are out and that round ends. A new contestant will then be called to participate in “round 2” which will follow the same format as round 1. Fandom expects that this will continue for 8 rounds (so there are 8 potential winners). Fandom will then hold a final round (“round 9”) in which the eligible contestants are limited to fans who participated in one of rounds 1 through 8.
Prize: All qualified contestants will receive a $25 Wendy’s gift card whether they win or lose. Each winner (if any) of rounds 1-8 will also receive a gift card with an approximate retail value of $150, and the winner (if any) of round 9 will receive a gift card with an approximate retail value of $500 (note that there is no guarantee that there will be a winner of any of the rounds). Winners may not substitute, assign or transfer prizes, but Sponsor reserves the right, at its sole discretion, to substitute prizes (or portions thereof) with one of comparable or greater value. Each winner is responsible for all applicable federal, state and local taxes, if any, as well as any other costs and expenses associated with prize acceptance and use not specified herein as being provided. All prize details are at Sponsor’s sole discretion.
Internet: The Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. The Sponsor is not responsible for any problems or technical malfunctions of the internet, computer systems, servers, or providers, software, failure of any e-mail or entry to be received by the Sponsor due to technical problems, human error or traffic congestion on the Internet or at any Web site, or any combination thereof, including any injury or damage to entrant’s or any other person’s computer relating to or resulting from participating in a Giveaway or downloading any materials in the Giveaway. SPONSOR IS NOT RESPONSIBLE FOR INCOMPATIBILITY OF ENTRANT’S HARDWARE, SOFTWARE OR BROWSER TECHNOLOGY WITH SPONSOR’S HARDWARE, SOFTWARE OR BROWSER TECHNOLOGY.
Notification of Winner: The winner may be required to execute and return a Prize Verification Form and Publicity Release (unless prohibited by Law) to the Sponsor within five (5) days of notification. If a selected winner is not an eligible entry, fails to comply with the Official Rules and/or to submit any required documentation within the designated period, or declines the Prize for any reason, that winner will be disqualified (in such a case, the Prize for that applicable round will not be awarded). Sponsor is not responsible for any change to your email, mailing address and/or telephone number.
General: By entering a Giveaway, entrants and prize winner: (1) agree to be bound by these Official Rules; (2) agree to release and hold harmless Sponsor and the Released Entities from and against any claim or cause of action arising out of participation in the Giveaway or receipt or use of any price including but not limited to: (a) unauthorized human intervention in the Giveaway; (b) technical errors related to computers, servers, providers, or telephone or network lines; (c) printing errors; or (d) errors in the administration of the Giveaway or the processing of entries; (3) agree to a complete release of Sponsor from any or all liability in connection with the Giveaway, (4) Entrant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages; and (5) consent to the use of his/her name, voice, picture, and likeness for advertising and promotional purposes in any medium throughout the world in perpetuity without additional compensation unless prohibited by law, and (6) acknowledges that Sponsor and the Released Entities have neither made nor are responsible or liable for any warranty, representation, or guarantee, express or implied, in fact or in law, relative to any prize, including but not limited to its quality, condition, or fitness for a particular purpose. Sponsor may discontinue any Giveaway at any time. Sponsor may terminate any Giveaway or decide to modify it in any manner that it deems fair and equitable to entrants if it becomes aware of any occurrence that would materially affect the Giveaway’s security and fairness. Sponsor may prohibit individuals from participating in a Giveaway and disqualify entries if they (1) attempt to enter the Giveaway through any means other than as described in these Official Rules, (2) attempt to disrupt the Giveaway or circumvent the terms and conditions of these Official Rules in any way or (3) repeatedly show a disregard for the Giveaway Official Rules or act (a) in an unsportsmanlike manner, or (b) with an intent to annoy, abuse, threaten or harass any other entrant or Sponsor. Sponsor’s decisions with respect to all Giveaways is final. Sponsor reserves the right to correct typographic, clerical or printing errors in any Giveaway materials. Sponsor is not responsible for any typographical or other error in the printing of a Giveaway, the administration of a Giveaway or in the announcement of a Prize Winner. In the event the Sponsor is prevented from continuing with a Giveaway, or the integrity and/or feasibility of a Giveaway is undermined by any event including but not limited to fire, flood, epidemic, earthquake, explosion, labor dispute, or strike, act of God or equipment failure, riot or civil disturbance, terrorist threat or activity, or any federal, state, provincial or local government law, order of regulation, order of any court or jurisdiction, or other cause not reasonably within the Sponsor’s control (each a “Force Majeure” event) the Sponsor shall have the right, in its sole discretion, to abbreviate, modify, suspend, cancel or terminate the Giveaway without notice or further obligation.
Use of information: The information that you provide in connection with the Giveaway may be used for Sponsor’s internal purposes and to send you information about Sponsor’s products and special promotions and may be shared with Sponsor’ affiliates or third parties.
